Terms and Conditions

You may use CulinaryNomics only if you are legally capable of entering into a binding contract under Indian law and have authority to act for the restaurant, company, outlet, franchise, or group whose data is submitted. If you use the service for an organization, "you" includes that organization.

• CulinaryNomics is currently offered as a pre-launch or pilot-stage SaaS product unless a signed agreement says otherwise.
• Features, reports, integrations, data formats, dashboards, support channels, and pricing may change as the product evolves.
• We may accept, pause, or decline pilot access based on capacity, data readiness, onboarding fit, legal risk, or operational constraints.
• Timelines shared during onboarding are estimates unless expressly stated as binding in a signed order form.

You retain ownership of the data you submit to CulinaryNomics. You grant us a limited right to host, process, analyze, transform, reproduce, display, and use that data to provide the service, support you, secure the platform, improve analytics, and meet legal or contractual obligations.

We may use aggregated, anonymized, or de-identified data for product development, benchmarking, internal analytics, and business reporting, provided the output does not reasonably identify you, your restaurant, your employees, or your customers.

• Provide accurate, lawful, and authorized data, and obtain all permissions needed from owners, employees, vendors, franchise partners, or other data sources.
• Do not upload unlawful, infringing, defamatory, obscene, harmful, misleading, fraudulent, or unauthorized content, or any content that violates applicable Indian law or the Information Technology rules.
• Keep credentials confidential, restrict account access, and promptly notify us of suspected misuse, unauthorized access, or data errors.
• Review reports before acting on them, because insights depend on data completeness, data quality, and business context.
• Use the service only for legitimate business purposes and not to reverse engineer, overload, scrape, resell, or disrupt CulinaryNomics.

Fees, billing cycles, taxes, implementation charges, and payment dates are set out on the pricing page, invoice, order form, or written proposal accepted by you. Unless stated otherwise, fees are exclusive of applicable taxes and are payable in Indian Rupees. Late, failed, or disputed payments may result in suspension or termination of access.

Refunds and cancellations are handled under our Refund Policy.

CulinaryNomics may rely on AWS and other third-party infrastructure, analytics, communication, deployment, payment, and support tools. AWS infrastructure and AWS's handling of cloud services are governed by AWS's applicable service terms, privacy notices, data processing terms, security policies, and acceptable use policies. Your use of CulinaryNomics must not cause us to violate those third-party terms.

CulinaryNomics, including its software, workflows, reports, dashboards, templates, designs, documentation, trademarks, know-how, models, and product logic, is owned by BrainBolt or its licensors. No rights are transferred to you except the limited right to use the service during your active pilot or subscription.

To the maximum extent permitted by applicable law, CulinaryNomics is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free analytics, specific cost savings, revenue outcomes, compliance outcomes, or compatibility with every POS, ERP, MMS, spreadsheet, or accounting format.

To the maximum extent permitted by applicable law, BrainBolt, CulinaryNomics, and their directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or loss-of-profit damages, loss of business, loss of goodwill, data loss, business interruption, or decisions made from reports.

To the maximum extent permitted by applicable law, our total aggregate liability for claims relating to CulinaryNomics is limited to the amount actually paid by you for the service in the one month before the event giving rise to the claim, or Rs. 10,000, whichever is lower, unless a signed written agreement with us states a different cap.

You agree to defend, indemnify, and hold harmless BrainBolt, CulinaryNomics, and their directors, employees, contractors, and affiliates from claims, losses, penalties, liabilities, costs, and expenses arising from your data, your misuse of the service, breach of these terms, unlawful instructions, infringement claims, or violation of applicable law.

We may suspend or terminate access where required for security, non-payment, suspected misuse, legal risk, unlawful content, breach of these terms, operational constraints, or discontinuation of the pilot. On termination, we may retain data as described in the Privacy Policy for legal, analytics, security, backup, audit, and dispute purposes.

These terms are governed by the laws of India. Courts and competent forums in India will have jurisdiction subject to applicable mandatory law and any signed agreement between you and us. Support, legal, and grievance communications can be sent to support@culinarynomics.com.

We may update these terms as the product, pricing, infrastructure, AWS usage, laws, or business model changes. Continued use of CulinaryNomics after an update means you accept the updated terms.
